Evicting Tenants – Tough Job for Property Manager

One of the toughest jobs available for a property manager is to evict the tenant from the property they are using. Several factors are taken into consideration why tenants are being evicted. Non-payment of rent, not following the rules and regulations set before closing the negotiations as well as creating problems in the neighborhood is some of the reasons why tenants are evicted.

One of the common problem that property manager face is when the tenant fails to pay on time or even pay the rent. Typically, when this happens, the landlord or the property manager will give a formal notice informing the tenant that the rent is overdue. If the tenant fails to pay the rent on the specified date, the tenant may start to file for eviction process. It is essential to give notice before evicting a tenant. If the tenant refuses to leave, do not consider forcing them out of your property. This will result to a criminal offence that you might suffer.

Violation of lease is also a factor in evicting a tenant. Same as non-payment of rent, you should send a formal notice to the tenant informing them of their violation. You may put there a specified time for the tenant to fix the problem. Also make them respond to your notice by asking them to write a formal letter. This will serve as a document that you may present in court or to a judge in the future. Tenants may easily claim that they didn’t receive any notice or warning as well as they can claim that the terms of the lease are not clear to them. The document will be a good way to convince the court that you went through the proper process and made the tenant aware of their responsibilities. Usually, several warnings are issued before you evict a tenant. This is the less expensive way of settling problems between a tenant and a property manager.

Some tenants also creates problem within the area or the neighborhood. Before closing a deal with a tenant and have them use your property, there is a contract that will bind the property manager and a tenant. Some contracts include that pets or animals are not allowed to loiter in the neighborhood. Tenants usually take this rule for granted that they continue to have their pets roam around the area. The tenants could be charged for breach of contract. As simple as it is, every rules and regulations in the contract are made because there is a purpose. Tenants will have to follow what is stated in the contract. If the tenant also deals in illegal activities such as drugs, they can be evicted.

Evicting a tenant not only takes time but it also takes a lot of patience and understanding. Definitely no one wants to go on court trial because it is time-consuming as well as it would be inconvenient for both parties. As a property manager, you have to bear in mind is that this is a business. No matter how hard it is to evict a tenant, if you are not getting what is due for your property, you just have to go through the process of eviction.
